Terms & Conditions

TURNAROUND TIMES ARE NOT GUARANTEED

All of our turnaround times are estimates only and NOT guarantees. Please keep in mind that there are several different things that can go wrong with the printing process that are out of our control. The turnaround times that we give are based on actual statistics of jobs we have done in the past and are NOT guaranteed. Under no circumstances will a refund be honored for a delay in our estimated turnaround time. All orders placed after 12pm EST will be processed the following business day.

COLORS ARE NOT GUARANTEED

Because of limitations with our printing process, as well as neighboring image ink requirements, the accuracy of color reproduction is not guaranteed and by placing an order with us you agree to this limitation. We accept no responsibility for color variations between submitted files and the final printed piece. Under no circumstances will a refund or reprint be honored for color variations that have occurred during the printing process.

CUTTING & SIZE LIMITATIONS

We accept no responsibility for size variations below or above 1/16′′ to 1/8′′. We strongly recommend that you do not use borders on your print job. Since the cuts may be off slightly by as much as 1/8′′, folds, perforations, and score lines may also be off by as much as 1/8′′. Under no circumstances will a refund or reprint be honored for cutting or size variations that have occurred during the printing process within these specifications.

QUANTITY VARIATIONS

Most of the time we will print slightly more than what you ordered, for no additional charge. As printing industry trade standards allow for underages of up to 10%, sometimes we will print slightly fewer pieces than you ordered. If you are doing a mailing and need to receive the exact amount ordered, it is best to communicate this to someone in our production department at the time you place your order. Under no circumstances will a refund or reprint be honored for a quantity that was shorted less than 10%.

COPY & DESIGN ERRORS

By the time your job gets in our hands and we are ready to go to print, all edits should be finalized, the copy carefully proofread and all design issues should be settled. We will not take responsibility for any copy or design errors committed on your part. We are also not responsible for any wrong dates or misspelled words in files submitted by customer or jobs approved by customer upon design completion. Under no circumstances will a refund or free reprint be honored for an error in the file submitted or the design that was approved.

 

NATIONWIDE SHIPPING

We will not be responsible for shipping delays or lost shipments caused by third party shipping companies. Under no circumstances will a refund or reprint be honored for a shipping delay or lost shipment.

 

PAYMENT IN ADVANCE

All of our orders MUST be paid in advance with either cash, Visa, MasterCard, Discover, or American Express. Personal or business checks will cause a delay in your job because we will not put your order in production until check clears. There are absolutely no exceptions. Under no circumstances will we be held responsible for delayed production of a job due to non- payment.

 

CANCELLATION & REFUND POLICY

There is absolutely no way to cancel the order. There are absolutely no exceptions. Customer agrees that by placing an order with us, the Customer has incurred and is paying for services provided and that regardless of whether the Customer refuses to take delivery of such product

ordered, Captured Visuals shall be paid in full. The Customer agrees that by placing any such order, the Customer will not cancel or terminate the order or refuse any such payment for the services provided. In the event that you cancel an order before production begins, the Customer will be eligible for a refund in the form of in-store credit, which will remain valid for 30 days before expiring. In some cases where no work has been done or no print file has been added to your order we will process a refund back to the payment method used. We will charge a 18% processing fee on all cash back orders. In addition, the Customer authorizes Captured Visuals to use these terms and conditions with any credit card company or financial institution to establish that Customer is not allowed to cancel any such order and that any such charge-back is improper. If a quality check has not been added to your product order, the customer takes full responsibility for the bleed, quality, and the resolution of the artwork that was uploaded, and any poor cutting or pixelation that occurs as a result and therefore will not be eligible for refunding.

 

SERVICES AND CONDITIONS OF USE

As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms and conditions set forth herein. Upon notice published through our website, we may modify these terms and conditions at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as ‘customer’ in this agreement.

 

Please note that we cannot be responsible for:

  • Spelling, punctuation or grammatical errors made by the end user.

  • Inferior quality or low-resolution of submitted images.

  • Design errors introduced by the customer in the document creation process.

  • Errors in user-selected options such as choice of finish, quantity or product type.

  • Damage to the products arising after delivery to the end user.

  • The differentiation of colors and sizes as they appear on the computer screen of the end user during the ordering processprior to processing, as compared to the finished products.

  • Please preview your designs carefully and correct any mistakes prior to placing your order. In an effort to keep costs down and pass substantial savings along to our customers, we do not proof documents created by the end users prior to processing. INDEMNIFICATION

The customer will indemnify and hold harmless, Captured Visuals and its affiliates, from any and all loss, cost expense, and damages on any and all manner of claims, demands, actions and proceeding that may be instituted against Captured Visuals on the grounds or basis alleging that said printing violates any copyright or any proprietary right of any person. You certify that you own the rights to use the image(s) being reproduced on your order.

 

RULES OF CONDUCT

By using our service, you agree that you will not attempt to undermine the integrity of Captured Visuals.

 

RIGHT TO SUBCONTRACT

Captured Visuals shall have the right to assign any portion of the work required to another contractor.

 

SAMPLE USE

Captured Visuals may use your product for samples or advertising purposes.

 

LIMITATION OF LIABILITY AND WARRANTY

THE CUSTOMER AND USER OF CAPTURED VISUALS (“CUSTOMER”) AGREES THAT USE OF THE SERVICE IS ENTIRELY AT CUSTOMER’S OWN RISK. SERVICES AND PRODUCTS ARE PROVIDED ‘AS IS,’ WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE.

LICENSED TO THE CUSTOMER AND THE RESULTS OBTAINED THROUGH THE SERVICE. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. CUSTOMER SPECIFICALLY ACKNOWLEDGES THE SERVICE IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR

ILLEGAL CONDUCT OF OTHER CUSTOMERS OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH CUSTOMER.

NEITHER CAPTURED VISUALS NOR ANY OF ITS AGENTS, AFFILIATES OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. CUSTOMER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE SERVICE.

 

CHANGES

Captured Visuals may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless we tell you otherwise. This policy was updated on April 14th, 2019.
